Even as Sanjay Dutt and his wife Manyata are seeking withdrawal of their marriage registration in Goa, the state authorities are probing how a senior officer accepted the annexed documents that were "full of flaws".
In a major lapse, the investigations into Sanjay Dutt and Manyata's documents have revealed that neither Dutt nor Manyata had filed their divorce decree which is mandatory before accepting the declaration of marriage under Portuguese laws in Goa before Sub-Registrar C Pissurlekar.
Dutt had attached a 'Rojnama' (court noting) from the court of Principal Judge, Family Court, Mumbai at Bandra which had sought to curtail the waiting period of six months before the marriage was declared legal. Sources said that Principal judge A V Nigude signed the Rojnama in Sanjay Dutt and Rhea Dutt divorce petition on February six, a day before Sanjay and Manyata filed their marriage declaration in Goa.
"It was an order to get divorce decree. The actual decree should have been attached by Dutt with the documents while filing declaration to get married to Manyata," state law department official said. District Registrar P S Borco, who is the investigating officer in the case, in his report to the law department, has said that the Rojnama submitted by Dutt does not carry signature of the judge and is not attested by the gazetted officer.
"In the present case (Dutt and Manyata), no judgement or order is filed and it is not known whether suit for divorce was complete in both the cases," according to the Borco's report. Borco has also held that the civil registrar should have refused to accept the declaration of marriage on the grounds that marital status of Manyata in affidavit and residence certificate are contradictory.
"Sub registar should have insisted for decree of divorce," he added. During investigations, it was found that Manyata in her residence certificate has termed her marital status as "unmarried" while affidavit shows her as a "divorcee". The law department officials confirming the receipt of report, said that they would initiate further action after consulting senior officials.

There seems to be no end in sight for the troubles of Sanjay Dutt and his companion Manyata who got “married” a few weeks back.
Just days after the couple withdrew their joint declaration of registered marriage, there is more trouble brewing for them.
Now, we learn that the wedding of Sanjay Dutt and ‘wife’ Manyata as per Hindu rites may be invalid if she has not converted to Hinduism before the marriage on February 11.
Manyata is in fact a Muslim and her real name is Dilnawaz Sheikh, reports say.
"According to the Hindu Marriage Act, if the couple are Hindus at the time of marriage, only then is the marriage valid under the Act," noted lawyer Mrunalini Deshmukh said.
"Even though Sanjay and Manyata have filed a joint declaration with South Goa's registration authorities seeking withdrawal of their marriage declaration, they will be husband and wife if their marriage as per the Hindu Marriage Act is valid," Deskhmukh said.
But if Manyata has not converted before the marriage rites, then either party can challenge the marriage at the time of annulment, as it is an invalid marriage.
The joint declaration filed by the couple before South Goa's Salcette Sub registrar's office states that they do not desire to solemnise their marriage under the Portuguese Civil Code, 1867.

When Goa authorities learnt that the domicile certificate Manyata submitted was false, they served a show-cause notice on her last week and asked her why this certificate should not be cancelled.
Manyata has sought a fortnight's time to file her reply to the notice.

We had published an article last week regarding the questions being raised on the legality of Manyata’s wedding to Sanjay Dutt. Trouble started when questions were raised on the authenticity of the residency certificate submitted by Manyata, though she had hardly resided in Goa.
The officials in Goa issued a show-cause notice to Manyata asking her to explain the reason for producing a duplicate resident certificate; one that she had produced for marrying Sanjay Dutt on February 7.
An officer at Salcete said that the office has issued a notice to Manyata’s Margao address asking her statement. Her marriage registration is also being kept on hold and the official who had produced the false residential certificate without proper verification, has been suspended.
If the officials come to know that the certificate is bogus then the marriage will not be considered as legal. If reports are to be believed, then there are also talks doing the rounds as to how Manyata could have married Sanjay when she has not been issued a legal divorce notice by her previous husband.

Authorities in Goa have ordered an inquiry into the entire marriage registration process of Bollywood star Sanjay Dutt and his girlfriend Manyata after it came to light that she had managed to get a residence certificate without living in the state.
The couple had submitted their declaration of marriage to sub registrar’s office in Salcette on February seven while the final signature is awaited.
Sources said South Goa district collectorate has taken to task a local panchayat official (government officer) who had issued residence certificate to Manyata.
The inquiry by the district collector has been ordered into how certificate was issued to Manyata when she is not a Goa resident, an official said.
For any marriage to be registered in Goa, one of the couple has to be a Goa resident which needs to be certified by the local authorities.
Sources said the state authorities are also inquiring into how the declaration was accepted when Manyata has not attached the decree of her divorce along with the affidavit filed.
The marriage declaration was registered in the Salcette sub registrar’s office and it awaits final signature which is required to declare Dutt's marriage as legal.

New Delhi, Feb 12: A day after Sanjay Dutt married his girlfriend Manyata in Mumbai, reports have emerged suggesting that the one time item girl is not divorced from her first husband. Her first husband, Meraj ul Rehman, has alleged that they got married in 2003 and have not formally separated yet.
There are rumours that this is Manyata’s fourth marriage. Sanjay, ofcourse, has been married before this, too.
Meraj and Manyata, reportedly have a son who is staying in Dubai with Manyata’s relatives. Meraj said that he just wants his son back from wife Manyata.
Meraj has been a struggling writer in the film industry and is presently in jail. He is accused of sending vulgar SMSs to some Bollywood actresses.
In support of his allegations, Meraj has produced some photographs (in possession of Zee News) of their marriage and honeymoon along with Manyata’s pregnancy reports.

A visibly happy Sanjay Dutt married Manyata according to Hindu rituals at a friend's house here Monday, five days after their court marriage in Goa. The Bollywood star's two younger sisters, Priya and Namrata, and other family relatives did not attend the ceremony.
According to some report Sanju and Manayata hurriedly tied the knot as the new Mrs Dutt is already pregnant. It was she who conveniently ‘leaked’ the details of the venue to the press. In fact she desperately wanted the news of their wedding to be featured prominently by the press.
The Munnabhai star, accompanied by a few close friends, arrived at Versova, a posh locality in north-west Mumbai, for the ceremony in the morning with the band playing music.
The merry-making baratis comprised only a few close childhood friends of the actor. Except for Suneil Shetty and director and TV presenter Sajid Khan, his colleagues from Bollywood were also not present.
He had married Manyata, his girl friend of two years, at a quiet court marriage in Goa Thursday, Feb 7.
The marriage rituals Monday were held at the seventh floor flat of a friend in a high-rise residential building in Versova. Since, according to Hindu custom, the girl has to be 'given away' in marriage by her parents or close relatives, Manyata had arranged the sacred formalities at the house of one of her friends.
'It was a private ceremony held at a friend's house. So, Sanju called only his closest friends. He may host a reception for the industry later,' said Bunty Walia, a close friend of the Dutts.
When asked why she did not attend, Priya Dutt, Congress MP from northwest Mumbai, feigned ignorance about the ceremony. She said she had come to know about it after television channels telecast the proceedings live.
The newly weds interacted freely with the media and both were courteous to journalists, unlike in the past when they tried to avoid them.
Happiness was writ large on their faces as they came down from the seventh floor after the rituals were over.
It was years since Sanjay has let himself go in public as uninhibitedly as he did Monday, as a band played the beat of a popular marriage movie song.
Suddenly, the lines of anxiety observed when he had come out of jail last time disappeared from his face as he mingled with the invitees and the waiting media-persons.
On Monday, the couple was no longer cagey about the whole affair, which was the subject of much speculation since October 2007.
They went out of the way to portray themselves as a happily married couple, unmindful of all the controversies dogging them. They also willingly posed for photographs.
When we first broke the news about their being husband and wife after they put in an advertisement as 'Mr. Sanjay Dutt and Mrs. Manyata Dutt' in Shiv Sena's mouthpiece Saamna offering their best wishes to Shiv Sena supreme Bal Thackeray on his 82nd birthday Jan 23, the duo had not reacted.
On Feb 9, Manyata attended a public function sporting vermilion, traditional mark of a married Hindu woman, on her forehead, and admitted that she and Sanjay were married.

Ending all speculation, Dutt (48) and Manyata Dilnasheen Amir Ahmed Sheikh (32) exchanged their nuptial vows at the bride's residence at suburban Versova.
The formal wedding was attended by close friends. However, Dutt's family members, including sisters Priya Dutt and Namrata Gaurav, were conspicuous by their absence.
After the marriage, a beaming Dutt, wearing a golden hued kurta-pyjama with a red embroidered 'chunri,' said he was very happy and thanked all his fans.
Lobbing a question at the media, Dutt asked: "Are you happy with my marriage?" On getting an affirmative reply, he thanked them and said, "I am also very happy and I thank you for the positive support."
Manyata, who appeared overwhelmed by the occasion, said, "I am so happy that I don't have words to express."
Manyata looked every inch a typical Indian bride with her forehead and her hair parting full of sindoor.
Asked about his daughter Trishala's reaction, Dutt paused and said, "She is happy."
Trishala (18) was born out of Dutt's first wife Richa Sharma, who died of cancer. She is abroad and told a TV channel "I have nothing to say."
